Money, Influence and the Election of Judges

    美国当选法官本周收到关于金钱,政治和法律的警告。最高法院判决,大型捐赠活动可以作为不参与捐赠者卷入的案件的审判工作的充分理由。

    全国50个州中有39个州的部分法官由选举产生。任期从2年至12年不等。专家称,其他国家只有日本和瑞士执行某种司法选举制度。

    在许多州,法官选举竞争越来越激烈。美国股权运动法官称,2000年至2007年之间,候选人募集了1.68亿美元的资金。该组织称,这个数字是90年代的两倍。

    有评论称,这种形式威胁到州法院的公平性,会给人造成法官出售影响力的感觉。

    最高法院对五年前当选为西佛吉尼亚高等法院的法官投票进行裁决。当时的法官Brent Benjamin——现任审判长——投票推翻对马西煤炭公司5000万美元的判决。

    马西主席曾赞助300万美元帮助其竞选西佛吉尼亚高等法院法官。此前马西公司曾经在一起商业纠纷的陪审团审判中失败。

    Benjamin法官拒绝退出马西案件,并投了决定性的一票。他给出的不退出的理由是,他并没有为自己的决定获取经济利益。然而,捐赠占他竞选资金的60%。

    美国最高法院发现,该案件的“极端事实”使偏见的可能性达到了违反宪法的水平。并不是所有接受了捐赠的法官都要被取消资格,但是“这是特例”。

    但是9名法官的意见也有所分歧。首席法官John Roberts是四名持异议者之一。他说,最高法院没有给出明确指导,在什么样的情况下应该要求取消资格。他说,这会增加人们声称法官偏袒的主张,“而无论这些指控多么毫无根据”。

    致力于司法独立性的美国律师协会正在起草指导方针,指导法官什么样的情况下应该自动退出审判。协会主席William Weisenberg称,律师协会是为了更充分得利用价值取向的选举。委员会就是在这里向州政府提名候选人以备委任的。

    例句:It will take me at least thirty minutes to get there.

    语法:no every compaign是部分否定。

    英语中的部分否定(即不完全否定)有如下一些表示方法:

    一、 all 的否定式:not all…(或:all…not)表示"并非都……"、"不是所有的都……"例如:

    Not all men can be masters. (= All men cannot be masters.) 并非人人都能当头头。

    Not all bamboo grows tall. 并非所有的竹子都会长得很高。

    二、 both 的否定式:not…both (或:both… not) "并非两个……都……" 例如:

    I don't want both the books. 我不是两本书都要。

    Both (the) windows are not open. 两扇窗子并不都开着。

    三、 every…的否定式:"不是每……都……" 例如:

    Not every book is educative. (或:Every book is not educative.) 不是每本书都有教育意义的。

    Not everyone likes this book. 并非人人都喜欢这本书。

    This flower is not seen everywhere. 这花并不是随处可见的。

    四、 always的否定式:"并非总是(并非一直)……" 例如:

    He is not always so sad. 他并不是一直都这样悲伤。

    五、 entirely, altogether, completely 和quite 的否定式:"不完全……","并非完全……" 例如:

    The businessman is never to be entirely trusted. 不可以完全信任商人。

    He felt not altogether satisfied. 他并不完全满意。

    I don't agree completely. 我并不完全同意。

    What he did was not quite proper. 他做的不十分妥当。

    六、 all the time 的否定式:"并非一直……"、"未必老是……" 例如:

    A foolish man doesn't make a mistake all the time. 笨人未必老是犯错误。

    七、 not…and…的否定式,被否定的往往是and后面的那一部分。 例如:

    He did not speak clearly and correctly. 他讲得清楚但不正确。

    This film is not interesting and instructive. 这部电影有趣但无教育意义。

    She cannot sing and dance. 她会唱歌但不会跳舞。

    如果将and 换成or,not 对其后面的两部分就全盘否定了。

    He did not speak clearly or correctly. 他讲的既不清楚也不正确。

    如要对上述的all, both, every, always, 以及entirely, altogether, completely, quite 和 all the time 等词作完全否定,那就分别要用与之相对应的全否定词,如no, none, neither, no one, never, not (never)… at all 等。例如:

    All of them can do it.--- None of them can do it.

    Both are good.---Neither is good.

    Everybody likes it. ---Nobody likes it.

    He is always late. --- He is never late.

    We don't trust them entirely. --- We never trust them at all.

    He was here all the time. --- He was never here.

    3.This, he said, will lead to an increase in claims that judges are biased, "however groundless those charges may be."

           信息技术的使用可以给发展中国家带来巨大的进步。

    语法:however groundless无论多门没有根据,however可以用no matter how来代替。

    However和no matter how同义,都表示“无论如何”的意思,又都引导让步状语从句,但它们的修辞意味和使用场合有所不同。

    However是比较正式的用语,大都用于书面语,口语中较少使用;no matter how则比较口语化,它的语势比however重,故常用在强调的场合。

    请看下面的例句:

    The task must be done,however arduous it may be.

    无论多么艰难,这个任务一定要完成。

    (试比较一般句:The task must be done though it is arduous.)

    I'll take your words,no matter how harsh they may be.

    无论语气多么难听,我还是听你的话的。

    (试比较一般句:Although your words are harsh,I'll take them.)

    However有时可表达“然而”、“可是”之意,出现于句中或句尾。例:

    They said that it was so;they were mistaken,however.

    他们说事情就是如此,可是他们错了。

    与之类似区别的词语很多,例如whatever/no matter what、whenever/no matter when、wherever/no matter where、whichever/no matter which、whoever/no matter who。
