加州同性婚姻禁令被推翻,预计将提起上诉 Appeals Expected After California Gay Marriage Ban Overturned

美国加利福尼亚州反对同性结婚的人说,他们计划对一位联邦法官推翻该州禁止同性结婚的裁决提出上诉。

沃克法官星期三推翻了禁止同性婚姻的州法律,说这个法律没有为禁止同性结婚提供合理的根据。

这位旧金山的法官在他长达136页的裁定书中写道,有关的禁令阻碍了加州履行宪法赋予的提供平等婚姻的义务。

在2008年11月,加州选民以微弱多数通过了“8号提案”的议案。该议案把婚姻定义为一个男人与一个女人之间的结合。

该议案是在加州最高法院将同性婚姻合法化之后几个月内得到通过的。法律专家说,加州的这个案子可能会导致美国最高法院就把同性结婚与异性结婚加以区别对待是否符合宪法的问题作出裁决。

Opponents of same-sex marriage in California say they are planning to appeal a U.S. federal judge's ruling overturning the state's ban on the unions.

Judge Walker struck down the ban Wednesday, saying the law offers no rational basis for outlawing same-sex marriage.

In his 136-page decision, the San Francisco judge wrote that the ban prevents the state from fulfilling its constitutional obligation to provide marriages on an equal basis.

In November of 2008, California voters narrowly approved a measure known as Proposition 8, which defines marriage as the union between a man and a woman.

The measure was approved just months after California's Supreme Court legalized same-sex marriages. Legal experts say the California case could lead to a U.S. Supreme Court ruling on whether it is constitutional to treat same-sex unions differently from those between a man and a woman.
